Flex Spending Account 2022 - Open Enrollment Campaign

The 2022 open enrollment campaign for the New York State Flex Spending Account (FSA) will run from November 2, 2021, to November 29, 2021, at 10 pm.

The FSA, a program negotiated between the State and its public employee
unions, consists of three important benefits for employees – the Health Care Spending
Account (HCSA), the Dependent Care Advantage Account (DCAA), and the Adoption
Advantage Account. Eligible employees may choose to enroll in any or all of the
accounts. Paperless enrollment makes it easy for employees to apply online or through
a toll-free number.

For the 2022 plan year, employees may contribute up to $2,750 through pre-tax
payroll deductions to the HCSA for eligible health care expenses that are not covered
by a health insurance plan. The maximum contribution may be subject to change
annually since it is indexed to inflation. In addition, employees may contribute up to
$5,000 per year per household to a DCAA for elder care, disabled dependent care, or
child care expenses. Lastly, employees may contribute up to $14,440 to the Adoption
Advantage Account for expenses related to the adoption of an eligible child.

Contributions are deducted biweekly from an employee’s gross pay and
deposited into the appropriate account. After eligible services have been received, the
employee then submits a claim for reimbursement.

Certain employees are eligible for an employer contribution from their employer. The
DCAA employer contribution will be available in 2022 for unions that have agreements
to participate in the employer contribution program. The following employees are
currently eligible for the employer contribution:

  • Employees of Executive Branch state agencies, Roswell Park Cancer Institute, or
    State University of New York who are designated M/C or represented by CSEA,
  • Employees of the Legislature, NYSERDA, or Environmental Facilities
  • Employees of the Unified Court System, except those designated unrepresented (Negotiating Unit #88)

The employer contribution may be available to state employees in other bargaining
units for the 2022 plan year pending the conclusion of negotiations and ratified contracts.
Based on salary, the employer contribution will provide up to $800 for eligible
employees who enroll in the DCAA. For employer contribution updates, please visit the

The tax advantages of participating in the FSA can be significant for working
families. With the rising cost of everyday living expenses, we are pleased to offer a
benefit that helps stretch the dollars of our employees and their families.
Health Benefits Administrators will soon receive a detailed memo about the FSA,
advising them to direct interested state employees to the website or FSA toll-free
hotline. Agencies will soon receive new posters to display at worksites and informational
flyers to distribute to employees.
